Officer charged with an offence arising out of the administration of the duties of his appointment, and interdicted from discharging the duties of his appointment, is permitted to receive the full emoluments and advantages of his office until his defence has been received and considered.

In reply, I beg to inform Your Lordship that I am of opinion, and in this opinion the Executive Council, before whom I brought the matter, concur, that the existing practice should be modified in cases of defalcation or other loss of public money, when, as Your Lordship states, the payment of full salary to the interdicted officer is especially indefensible.
